CHAPTER 147. PARKS AND RECREATION AREAS

ARTICLE I. Hours of Operation

[Adopted at time of adoption of Code (see Ch. 1, General Provisions, Art. I)]

§ 147-1. Definitions.

As used in this article, the following terms shall have the meanings indicated:
PARK
City-owned real estate purchased or dedicated for use by the public for recreation or leisure activities.
RECREATION FACILITIES
City owned buildings or equipment purchased, constructed, leased, or dedicated for use by the public for recreation or leisure activities.

§ 147-2. Hours of operation.

All City park and recreation facilities shall be open and available for public use from sunrise until 10:00 p.m., at which time they shall be closed to all people and activities.

§ 147-3. Violations and penalties.

Any person violating the provisions of this article shall be guilty of a petty misdemeanor and shall be punished as provided by Chapter 1, Article III, General Penalty.

ARTICLE II. Alcohol in Kellogg City Park

[Adopted at time of adoption of Code (see Ch. 1, General Provisions, Art. I)]

§ 147-4. Definitions.

As used in this article, the following terms shall have the meanings indicated:
ALCOHOLIC BEVERAGE
Any liquid for drinking which contains any part alcohol, whether it be intoxicating or nonintoxicating.
DISPLAY
To place in view, exhibit, or show to the public an object in such a manner as one does not have to go out of one's way, strain, or maneuver into position to see said object.
KELLOGG CITY PARK
The park located on Belvidere Avenue.

§ 147-5. Permit required.

The consumption and/or possession of alcoholic beverages or containers shall at all times be prohibited unless proper permits are filed in the Kellogg City office and presented for approval by the City Council. Permit seekers must meet eligibility requirements for a permit as well as the requirments of all state and federal laws.

§ 147-6. Violations and penalties.

Any person violating the provisions of this article shall be guilty of a petty misdemeanor and shall be punished as provided by Chapter 1, Article III, General Penalty.

ARTICLE III. Alcohol in Softball Field Areas

[Adopted at time of adoption of Code (see Ch. 1, General Provisions, Art. I)]

§ 147-7. Definitions.

As used in this article, the following terms shall have the meanings indicated:
CITY OF KELLOGG SOFTBALL FIELD AREAS
That area within 75 feet of the concession stand and the fenced-in area for softball play.

§ 147-8. Consumption restricted.

The consumption and/or possession of alcoholic beverages or containers and/or food items not purchased from the concession stand shall be prohibited in the Kellogg Softball Field areas during those times when the concession stand is open.

§ 147-9. Violations and penalties

Any person violating the provisions of this article shall be guilty of a petty misdemeanor and shall be punished as provided by Chapter 1, Article III, General Penalty.
