CHAPTER 75. CIGARETTE SALES

§ 75-1. License required.

No person shall directly or indirectly or by means of any device keep for retail sale, sell at retail, or otherwise dispose of any cigarette, cigarette paper, or cigarette wrapper at any place in the City of Kellogg unless a license therefor has been obtained from the City Council on application from the Clerk/Treasurer.

§ 75-2. License fee.

Editor's Note: Amended at time of adoption of Code (see Ch. 1, General Provisions, Art. I). The fee for every license shall be as set by resolution of the City Council. Every license shall expire on December 31 of the year for which it is issued.

§ 75-3. Licensing restrictions.

No license shall be issued except to a person of good moral character. No license shall be issued for the sale of cigarettes at a movable place of business, nor shall any one license be issued for the sale of cigarettes at more than one place of business.

§ 75-4. Sale to minors; contents of cigarettes.

No person shall sell or give away, or permit any vending machine to be used to sell, any cigarette, cigarette paper or cigarette wrapper to any person below the age of 18 years. No person shall keep for sale, sell, or dispose of any cigarette containing opium, morphine, jimson weed, bella donna, strychnia, cocaine, marijuana, or any other deleterious or poisonous drug except nicotine.

§ 75-5. Violations and penalties.

Editor's Note: Amended at time of adoption of Code (see Ch. 1, General Provisions, Art. I). Any person who violates any provision of this chapter is guilty of a petty misdemeanor and shall be punishable as provided in Chapter 1, Article III, General Penalty.
