ARTICLE II. Nondomestic Animals
[Adopted at time of adoption of Code (see Ch. 1, General Provisions, Art. I)]
§ 58-17. Definitions.
As used in this article, the following words shall have the following meanings:- ANIMALS, NONDOMESTIC
- Livestock and poultry commonly kept for productive purposes on a farm, such as cattle, swine (pigs), horses, donkeys, sheep, goats, chickens and other similar animals.
§ 58-18. Rules and regulations.
A. Nondomestic animals are not permitted within the City limits.
B. On those lands that have nondomestic animals at the adoption of this article that are within the City limits can continue to be kept at the current intensity and type of animal, unless said property is sold, rented to another or the animals being kept expires, or for any reason, are no longer on the property. In such cases, nondomestic animals shall no longer be allowed.
§ 58-19. Violations and penalties.
A. First-time violators of this article shall receive a letter from the City Clerk/Treasurer along with a copy of this article.
B. Second-time violators of this article will be issued a citation from the City Clerk/Treasurer's office to be sent by certified mail, and a fine of $50 shall be imposed. The owner can request a hearing on the matter before the City Council if the owner contacts the Clerk/Treasurer's office within 10 days after receiving the citation. If so requested, the hearing will be held on the date of the next Council meeting. If a hearing is not requested by the owner, the fine must be paid within 10 days.
